Oliver studied mechanical engineering, with particular focus on automotive engineering and product development, at the Technical University of Munich (TUM), graduating in
2005. Oliver has worked in the field of industrial property rights since 2005. He is a qualified German and European patent attorney. In 2019, Oliver was appointed as member of the
Examination Commission for German Patent Attorneys by the Federal Ministry of Justice.
Before founding Wenzel Nemetzade Warthmüller Patentanwälte Part mbB, Oliver
worked for several years with leading patent prosecution and litigation law firms in the field of industrial property rights. He had earlier worked with one of the world's
leading manufacturers of plant and machinery used in the production and processing of synthetics and rubber, where he was responsible for all intellectual property rights matters
relating to reaction technology.
He has extensive experience in the field of contentious litigation relating to patent and utility model infringements. He advises and
represents clients on all aspects of technical IP rights, including application proceedings, oppositions, appeals and nullity actions. An important aspect of his work is the
preparation of expert opinions on infringement issues as well as freedom to operate reports. In addition to general mechanical engineering, he possesses extensive knowledge in the
fields of automobile and aviation technology, mechanical process engineering, outdoor and transportation products as well as sports equipment.
Amir studied mechanical engineering at the RWTH Aachen University (Rheinisch-Westfälische Technische Hochschule Aachen) with focus on production engineering. He has been working in
the field of intellectual property since 2009. In 2019 he was appointed to the Examination Commission for German Patent Attorneys by the Federal Ministry of Justice and is
committed to the training of young patent attorneys.
Before founding Wenzel Nemetzade Warthmüller Patentanwälte Part mbB, he worked for renowned patent law firms in
Munich, where he gained extensive experience in advising domestic and foreign clients.
Amir is an expert in German and European patent law. His professional focus is
on drafting patent applications and representing clients in proceedings with the German Patent and Trademark Office (GPTO) and the European Patent Office (EPO). He has also
extensive experience in complex adversarial proceedings and disputes, including nullity proceedings with the Federal Patent Court. A further focus of his legal practice lies in the
preparation of expert opinions on infringement and validity of German and European patents. He has particular technical expertise in the fields of mechanical engineering,
production technology, machine tools, automotive engineering and construction machinery, safety engineering, medical technology, information and communication technology,
measurement and control technology as well as software.
He also advises his clients on license agreements, in the field of employee invention law as well as on
trademarks and designs.
Jürgen Warthmüller studied mechanical engineering at the Technical University of Munich (TUM) with a focus on micro- and medical technology. He has been working in the field of
intellectual property since 2008. Jürgen is admitted as a German and European Patent Attorney and is also a European Trademark and Design Attorney.
Before founding
Wenzel Nemetzade Warthmüller Patentanwälte Part mbB, Jürgen worked for several renowned patent and law firms in Munich with a focus on prosecution and litigation.
His
main area is drafting applications and representing in patent and utility model proceedings using his experience gained in the field of litigation. Based on the profound knowledge
in general mechanical engineering, he has extensive knowledge in automotive engineering, everyday objects, outdoor sports equipment, bicycle technology as well as micro- and
medical technology. Jürgen advises medium-sized companies and corporations as well as entrepreneurs and individual inventors. He also advises his clients on trademark law, employee
invention law and design law. Due to his litigation background, Jürgen has extensive experience in drafting third-party objections as well as opposition and appeal proceedings
before the German Patent and Trademark Office and the European Patent Office. He also has expertise in patent disputes before the civil courts and in nullity proceedings before the
German Federal Patent Court.
In addition to that he also possesses expertise in drafting license agreements, infringement and validity opinions, as well as in the
evaluation and enforcement of intellectual property rights.
Dr. Gernot Krobath has studied physics at the University of Heidelberg and at the University of Oklahoma (USA) with a focus on experimental heavy ion physics. Then, he received a PhD from the University of Munich for his work in an elementary particle physics experiment at the European Organization for Nuclear Research (CERN) in which over 3000 physicists participate. Dr. Gernot Krobath has been working in the field of intellectual property since 2008.
Before joining the law firm Wenzel Nemetzade Warthmüller Patentanwälte Part mbB as a partner, Dr. Gernot Krobath has been a partner in a middle-sized patent law firm in Munich for many years and hereby gained in-depth knowledge in advising domestic and foreign clients in all matters of patent, trademark and design law.
Dr. Gernot Krobath has extensive experience as German Patent Attorney in German patent law in all matters of the German Patent and Trademark Office (GPTO) and of the Federal Patent Court. Furthermore, he has comprehensive experience as European Patent Attorney in European patent law before the European Patent Office (EPO) and the Technical Boards of Appeal. In particular, Dr. Gernot Krobath has plenty of experience in patent drafting and patent prosecution before the German Patent and Trademark Office as well as before the European Patent Office. Also, oppositions, nullity actions and patent infringement actions are part of his expertise. His technical special fields include optics, automotive engineering, electronics, general physics, medical engineering and computer implemented inventions (software patents).
Dr. Gernot Krobath has been lecturer at the University of Munich for the lecture “Introduction to German and European Patent Law for Physicists” since 2014. Also, Dr. Gernot Krobath has been speaker and head of the Management Circle seminar „Patent Law Compact“ for many years.
In 2022, Dr. Gernot Krobath published the book “Patent Law for Students of Natural Sciences - A Compact Introduction to the Basics” in German language in the Springer Spektrum publishing house.
Dr. Dirk Bastian is former presiding judge at the German Federal Patent Court and was previously, among other things, department president at the German Patent and Trademark
Office.
After his time at the German Federal Patent Court and prior to the cooperation with Wenzel Nemetzade Warthmüller Patentanwälte Part mbB, he worked as an
advisor for a renowned patent and law firm in Munich specializing in litigation.
Dr. Bastian supports with his expertise in the fields of electrical engineering and
physics, his valuable know-how of the Patent Office and the Federal Patent Court as well as with his many years of experience in a large number of patent law proceedings.
